Creator Scout Policies

These policies govern your use of the Creator Scout platform. Please read them carefully.

Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Creator Scout platform, operated by Scoutiq Technologies Pvt. Ltd., a company incorporated under the Companies Act, 2013, with its registered office in India.

1Acceptance of Terms

By registering on Creator Scout, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform. These Terms constitute a legally binding agreement between you and Creator Scout Pvt. Ltd.

You must be at least 18 years of age to register on Creator Scout. By creating an account, you represent and warrant that you meet this requirement.

2Who Can Use Creator Scout

Creator Scout is accessible to three types of users:

  • Brands & Businesses — Companies, D2C brands, agencies, and marketing teams looking to discover and collaborate with creators.
  • Individual Creators — Content creators, influencers, and social media personalities offering their services for brand collaborations.
  • Talent Agencies & Managers — Agencies and managers representing multiple creators and managing campaigns on their behalf.

Each user must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials.

3Platform Services

Creator Scout provides the following services:

  • Creator discovery and search tools for brands
  • Campaign creation, management, and tracking tools
  • Escrow-based payment infrastructure for campaign transactions
  • Subscription plans with tiered feature access for brands and creators
  • In-built real-time chat for communication between brands and creators
  • SaaS tools including deliverable tracking, contract management, and analytics dashboards
  • Performance reporting and audience insights

Creator Scout acts as a technology platform and marketplace facilitator. We are not a party to the agreements entered between brands and creators, except as explicitly stated in these Terms.

4Escrow & Payment Terms

Creator Scout uses an escrow mechanism for campaign payments. Here is how it works:

  • When a brand initiates a campaign, the agreed campaign fee is deposited upfront into an escrow account held by Creator Scout or its authorised payment partner.
  • Funds are held in escrow until the brand approves the deliverables submitted by the creator.
  • Upon approval, funds are disbursed to the creator after deduction of the applicable platform commission.
  • Creator Scout charges a platform commission on the total campaign value from the brand side.
Creator Scout reserves the right to withhold or delay disbursement if there is an active dispute, suspected fraud, or violation of these Terms.

All payments are processed in Indian Rupees (INR). Creator Scout uses third-party payment gateways (such as Razorpay) for payment processing. By transacting on the platform, you also agree to the terms of the applicable payment gateway.

5Dispute Resolution

In the event of a dispute between a brand and a creator regarding deliverables:

  • Either party may raise a formal dispute through the Creator Scout dispute resolution interface within 7 days of deliverable submission.
  • Creator Scout’s mediation team will review the campaign brief, submitted deliverables, and communication logs via the in-platform chat.
  • Creator Scout will make a binding decision on the dispute, including whether to release, partially release, or return the escrowed funds.
  • Creator Scout’s decision shall be final and binding on both parties for the purposes of fund disbursement.
Creator Scout’s mediation is limited to fund disbursement decisions. Parties are free to pursue independent legal remedies separately. Creator Scout does not provide legal advice.

6Subscriptions

Creator Scout offers subscription plans for both brands and creators. Subscriptions are billed on a monthly or annual basis as selected at the time of purchase.

  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of the current billing cycle. You retain access to subscribed features until the cycle ends.
  • Creator Scout reserves the right to modify subscription pricing with 30 days prior notice.

7Prohibited Conduct

You agree not to:

  • Provide false, misleading, or fraudulent information during registration or in campaigns
  • Circumvent the platform by transacting directly with the other party to avoid platform fees
  • Engage in spam, harassment, or abusive communication via the in-platform chat
  • Upload content that is unlawful, defamatory, obscene, or infringes on third-party intellectual property
  • Attempt to reverse-engineer, scrape, or exploit the platform or its data
  • Use the platform for any purpose that violates applicable Indian law
  • Initiate a chargeback, payment reversal, or external bank dispute for funds successfully deposited into escrow on Creator Scout without first exhausting the platform’s dispute resolution process. Initiating a chargeback in lieu of the dispute process is a material breach of these Terms and may result in account suspension, legal recovery action, and permanent platform ban.

Violation of any of the above may result in immediate account suspension or termination without notice.

8Intellectual Property

Creator Scout and its underlying technology, branding, and content are the intellectual property of Scoutiq Technologies Pvt. Ltd. You may not reproduce, distribute, or create derivative works without express written permission.

Content created by creators for brand campaigns remains the intellectual property of the creator unless explicitly transferred to the brand under a separate written agreement between the parties.

Rights Grants

When a brand purchases a package that includes ad rights, usage rights, or an exclusivity period, those rights are granted to the brand for the duration specified in the package at the time of booking. The following applies to all rights grants on Creator Scout:

  • Ad Rights — The brand may use your content in paid advertisements (including Meta ads, Google ads, and similar platforms) for the duration purchased. Outside that window, they must stop running ads using your content.
  • Usage Rights — The brand may repurpose your content for organic posts, their website, email campaigns, and similar non-paid uses for the duration purchased.
  • Exclusivity — During the exclusivity period and category you agreed to, you may not accept paid partnerships with competing brands in that category. This only applies to paid work — you can still post organic content and work with non-competing brands freely.
  • Rights Library — All active rights grants are tracked in your Rights Library on your dashboard, including live expiry countdowns and renewal options.
  • Rights tied to completed orders — Rights are only granted when an order reaches ‘completed’ status. If an order is cancelled before completion, no rights are granted to the brand regardless of how much work was submitted.
  • Post-expiry usage — After rights expire, the brand must cease all usage covered by that right. You are not responsible for enforcing this — Creator Scout notifies both parties by email and in-app when rights are within 7 days of expiry and again on the day they expire.
  • Renewals — You can request renewal of any right from your Rights Library. Renewal requires a new order or a new agreement with the brand — it is not automatic.

9Limitation of Liability

Creator Scout is a technology platform and marketplace facilitator. To the maximum extent permitted by law, Creator Scout shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform, including but not limited to disputes between brands and creators, failed campaigns, or payment delays caused by third-party payment gateways.

Creator Scout’s total aggregate liability shall not exceed the total fees paid by you to Creator Scout in the three months preceding the claim.

10Governing Law & Jurisdiction

Any dispute arising out of or in connection with these Terms that is not resolved through Creator Scout’s internal dispute resolution process shall first be referred to arbitration before a sole arbitrator mutually appointed by the parties, conducted in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Indore, Madhya Pradesh, and proceedings conducted in English. Either party may seek urgent interim relief from a court of competent jurisdiction pending arbitration.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Chhatarpur, Madhya Pradesh, India.

11Amendments

Creator Scout reserves the right to update these Terms at any time. Users will be notified of material changes via email or platform notification. Continued use of the platform after such notice constitutes acceptance of the revised Terms.

12Instagram Integration

By connecting your Instagram account to Creator Scout, you authorize us to access your Instagram business account data including follower count, post engagement metrics, and profile information via the Instagram Graph API. You can revoke this access at any time from your Instagram settings or Creator Scout account settings.

Instagram analytics displayed on your Creator Scout profile are fetched directly from Instagram and updated daily. Creator Scout does not manually alter or inflate these figures. Engagement rate is calculated from your most recent 20 posts.

Creator Scout operates in compliance with Meta’s Platform Terms. Any misuse of the Instagram connection feature, including attempting to manipulate analytics data, may result in account suspension.
